These Terms of Use and Terms of Sale (hereinafter the "ToS") govern access to and use of the FocUS mobile app published by NIHILOPS and its associated services. By installing, creating an account, or subscribing to a plan on the FocUS app, you unconditionally accept all of these terms in full.
The FocUS mobile app is published by NIHILOPS to provide pet owners with digital tools for organisation, health tracking, walk recording, and nutritional calculation assistance.

FocUS offers two service levels:
THE FOCUS APPLICATION IS NOT A MEDICAL DEVICE AND IN NO WAY REPLACES A VETERINARIAN.
1. Strictly indicative nature: Features based on Artificial Intelligence (Food Scanner, ingredient recognition, FEDIAF/NRC energy requirement calculations, portion estimates, and wellness scores) provide automated estimates that may contain errors, omissions, or approximations.
2. Exclusive user responsibility: You alone are responsible for the choice of diet, dosages, hygiene care, and administration of treatments prescribed for your animals.
3. Full exemption: The publisher of FocUS shall in no event be held liable for any direct or indirect damage, health disorder, deficiency, poisoning, accident, or death of an animal resulting from the use of information or calculations generated by the application. In case of doubt or emergency, immediately consult a qualified veterinarian.
Paid subscriptions to FocUS Premium are marketed and governed under the following terms:
On Android devices, transactions, collections, currency conversions, and VAT collection are managed directly by Google Ireland Limited (Google Play Billing) acting as the official merchant (*Merchant of Record*).
The applicable prices are those shown on the app's product listing and on the Google Play Store at the time of subscription. Unless you cancel before the due date, subscriptions (monthly or annual) are automatically renewed for an identical period at the prevailing price.
You can cancel your subscription at any time without cause:
In accordance with Google Play Store rules, cancellation stops future charges but does not entitle you to a retroactive refund pro-rated for the current period. You retain your Premium access until the end of the billing period already started.
In accordance with European Union consumer protection rules and Google Play policies, immediate refund requests made within 48 hours of the initial purchase must be submitted directly through the Google Play refund centre.
The publisher strives to keep the application accessible 24/7. However, access may be temporarily interrupted for maintenance, technical improvement, network failure, or force majeure without engaging the publisher's liability.
The publisher reserves the right to evolve, add, or adapt the application's features to ensure its longevity and security.
All elements comprising the FocUS application (source code, algorithms, interactive 3D badge, vector logo, designs, graphics, and databases) are protected by intellectual property law. Any unauthorised reproduction or decompilation is strictly prohibited.
FocUS respects the confidentiality of your personal data and European regulations (GDPR). To learn about your rights of access, rectification, and deletion of your data, please review our Privacy Policy.
These ToS are governed by French law. In the event of a claim or dispute relating to the interpretation or performance of the contract, the parties undertake to first seek an amicable solution by contacting technical support. Failing an amicable agreement, the competent French courts shall have sole jurisdiction to settle the dispute.
